Mr. Vikas Singh Yadav and Ms. Neelam Godiyal, Advocates for the petitioner. Mr. N.S. Pundir, D.A.G. for the State. By means of the instant petition, the petitioner seeks the following reliefs:- i. Issue a writ, order or direction in the nature of mandamus directing the respondents to forthwith regularize the services of the petitioner on the post of ‘Safai Nayak’ pursuant to Regularization Rules, and also considering one time settlement for regular posting as approved by State Government, petitioner further prays for a direction to the respondents to grant Minimum of Regular Pay Scale along with Dearness Allowances of the post of ‘Safai Nayak’ on the principle of equal pay for equal work (as revised from time to time). ii. Issue any writ or order which this Hon’ble Court may deem fit in the interest of justice. iii. Award cost of the petition in favour of the petitioner. Heard. Learned counsel for the petitioner submits that the petitioner has been working as Safai Nayak since 1996 with the respondents- department; his services has yet not been regularised and he is not being paid minimum wages. He further submits that the petitioner may be given liberty to make a fresh representation to the respondents-department with the directions to the respondents-department to decide
the representation within a stipulated time with a reasoned and speaking order. Learned State Counsel submits that in case the petitioner gives a fresh representation, it shall be decided within a period of three weeks from the date of its receipt. The Court takes on record the statement given by learned State Counsel. The writ petition is disposed of with the liberty to the petitioner to move a fresh representation to the respondents authorities within a week. The respondents authorities are further directed to take a decision on such representation within a period of three weeks, thereafter, in accordance with law, with a reasoned and speaking order.
