Heard the parties.
2. The petitioner has been made accused in connection with Masalia P.S. Case No. 43 of 2024, for the offence registered under Section 303(2) of B.N.S., 2023, pending in the court of learned S.D.J.M., Dumka.
3. On 01.09.2024, theft was committed in B.S.N.L. Tower located at Golbazar, Sibakol and Kenduatanr by the unknown persons. They took away 24 batteries from there.
4. It was submitted that nothing incriminating was recovered from the possession of the petitioner. It was further submitted that the petitioner is in custody for about six months. It was finally submitted that co-accused Anaul Miyan has been granted bail by this Court vide B.A. No. 1878 of 2025 and co-accused namely Raju Ansari has been granted bail by this Court in B.A. No. 2280/2025.
5. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Dumka in connection with Masalia P.S. Case No. 43 of 2024.
