Arb Appln No. 1705 of 2025 __________ Page2 of 4 O R D E R This application has been filed to direct the respondent to furnish security for a sum of Rs.15,69,709/- within the time stipulated by this Court failing which to pass an order directing the Garnishee to deduct and deposit the amount payable to the respondent towards salary and also direct the Garnishee to deposit the amount to the credit of this application. 2. Today when the matter is taken up for hearing, learned counsel, who appeared on behalf of the respondent, would submit that the respondent had taken back the bundle along with change of vakalat from him. However, the respondent, who had filed a counter, had not taken any steps to engage a counsel and file the change of vakalat on his behalf. 3. This Court during the earlier hearing on 01.07.2026 had directed the respondent to furnish security by considering the fact that in the counter filed, no reasons have been given as to why he is not required to furnish security, that too in a post-award application. In spite of which, the respondent’s conduct is delaying compliance with the order dated 01.07.2026. It is only a dilatory tactics adopted by him. https://www.mhc.tn.gov.in/judis

In such view of the matter, there shall be a direction to the Garnishee to deduct a sum of Rs.15,000/-, which this Court arrives by considering the salary slip (Pay slip for the month of March 2024), which indicates that the total payable gross salary of the respondent is Rs.90,636/- in which a deduction of Rs.28,551/- is being made and net salary is only Rs.62,085/-. The said sum of Rs.15,000/- is arrived at in view of the restriction placed under Section 18 of the Code of Wages, 2019. On deducting the said amount, the Garnishee/second respondent shall pay the said amount of Rs.15,000/- (Rupees Fifteen Thousand only) to the applicant. 5.
