The petitioner is apprehending his arrest in connection with R.C. Case No. 05(A)/2012-AHD-R, registered for the offences under Sections 420, 423, 424, 467, 468, 469, 471, 477-A, 120-B, 109 and 201 of the Indian Penal Code and Section 13(2) read with Sections 13(1)(d) of the Prevention of Corruption Act, pending in the court of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi. 3. Mr. Ajit Kumar, learned senior counsel appearing for the petitioner submits that the petitioner has appeared in the examination conducted by the Jharkhand Public Service Commission in the year 2003 and only allegation levelled against this petitioner is that he has been provided 06 extra marks by the examiner in one of the paper. He submits that now the chargesheet has already been submitted and in view that the petitioner may kindly be provided the privilege of anticipatory bail. 4. Mr. Prashant Pallav, learned D.S.G.I. appearing for the CBI has opposed the prayer and submits that the allegations are there against the petitioner of obtaining arbitrarily 06 marks in the [2025:JHHC:22075 ] -2- examination conducted by the Jharkhand Public Service Commission from the examiner. 5. Considering that the chargesheet has already been submitted and during investigation, it appears that the petitioner has co-operated in the investigation that’s why the CBI has not arrested him and only allegation is there against the petitioner of obtaining 06 more marks from the examiner, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi, in connection with R.C. Case No. 05(A)/2012-AHD-R, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Amitesh/-
