Respondent(s) For Applicant(s): Mr.Avinash Wadhwani For Respondent(s): Mr.S.V.Karthikeyan ORDER This application has been filed to extend the mandate of the Arbitral Tribunal for a period of six months. 2.Heard Mr.Avinash Wadhwani, learned counsel for the applicant and Mr.S.V.Karthikeyan, learned counsel for the respondent though vakalat is yet to be entered in the Registry, however the same counsel in fact appeared before the Arbitral Tribunal as well. 1/2 https://www.mhc.tn.gov.in/judis A NO. 6167 of 2024 3.According to the learned counsel for the applicant, the respondent has been wantonly delaying the proceedings at every stage of the arbitration and despite the same, it is only the applicant who has come forward seeking the extension of the mandate of the Arbitral Tribunal. The learned counsel for the applicant would also invite my attention to the minutes of the arbitration in IAF.No.7 of 2022 for the period 2023-2024. On perusal of the same, I am able to see that it is only the respondent who has been taking repeated adjournments under some pretext or the other and that has resulted in the expiry of the mandate of the Arbitral Tribunal and neither the applicant nor the Arbitral Tribunal is at fault. 4.In such view of the matter, I am inclined to grant extension of time at the request of the applicant/claimant before the Arbitral Tribunal. Accordingly, this application is ordered and the mandate of the Arbitral Tribunal is extended by six months from the date of receipt of a copy of this order. 31-01-2025 ata To 1.
