Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.. The present application under Section 528 B.N.S.S. has been filed to quash the N.B.W. order dated 08.08.2025 passed by A.C.J. (J.D.)/J.M., Court No. 2, Sambhal in Case No. 290 of 2007 (State Vs. Munni and others) arising out of Case Crime No. 917 of 2006 under Section 323 IPC, Police Station-Nakhasa, District- Sambhal, pending in the Court of A.C.J. (J.D.)/J.M., Court No. 2, Sambhal and also to direct the learned A.C.J. (J.D.)/J.M., Court No. 2, Sambhal to permit the applicants to face the rest of trial in Case No. 290 of 2007 (State Vs. Munni and others) arising out of Case Crime No. 917 of 2006, under Section 323 IPC, Police Station-Nakhasa, District-Sambhal on the bail bond as already been furnished by the appliants in the said case and further directed the court below to decide the same expeditiously. It has been submitted by learned counsel for the applicants that the applicants were already released on bail but they could not put their signatures on the said proceedings. They could not be released on bail and the non-bailable warrant dated 08.08.2025 has been issued. Versus Counsel for Applicant(s) : Jayant Prakash Singh Counsel for Opposite Party(s) : G.A. Munni And 2 Others .....Applicant(s) State of U.P. and Another .....Opposite Party(s) Considering the facts and circumstances of the case, the petition is disposed of with the direction to the Court concerned to take appropriate steps for the release of the applicants, in accordance with law. With the aforesaid direction, the application is disposed of. In the meantime, no coercive measures shall be taken against the applicants.
