CRM-M-45742-2025 -1- 105 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-45742-2025 DATE OF DECISION : 21.08.2025 PARDEEP ALIAS DEEP ...PETITIONER VERSUS STATE OF HARYANA ....RESPONDENT CORAM: HON'BLE MR. JUSTICE SUBHAS MEHLA Present: Mr. Abhayjeet Singh, Advocate for the petitioner. Mr. Karan Veer Singh, Sr. Deputy Advocate General, Haryana. SUBHAS MEHLA, J. (ORAL) 1. The instant petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS, 2023’) seeking grant of pre-arrest bail in FIR No. 543 dated 08.07.2025 under Sections 351(3) and 110 of B.N.S. registered at Police Station Barwala, District Hisar Haryana. 2. Learned counsel for the petitioner contended that the petitioner has been falsely implicated in this case. The complainant has given an exaggerated version regarding the incident. He received only blunt injuries. The petitioner is not required for any custodial interrogation as the tractor and rotavator are not the things which are to be concealed or recovered from his possession and prays for grant of anticipatory bail to the petitioner. Learned State counsel, appearing on advance notice, opposed the grant of bail to the petitioner and contended that as per prosecution case, petitioner drove his tractor fitted with rotavator over the body of the complainant and caused grievous injuries to his head, face, hands and other vital parts of the body. Recovery of tractor and rotavator is yet to be effected. 4. Heard. 5. In view of the statement made by learned State counsel and the manner in which the offence is committed; allegations against the present petitioner are serious in nature; he tried to mow the complainant under his tractor due to which complainant received injuries and he was medico- legally examined in this case; the present petitioner is required for custodial interrogation, so keeping in view the fact of the present case, this Court finds no merit in the present petition. 6. Dismissed.
