Singh, learned Senior Advocate assisted by Sri Narendra Kumar and Hritudhwaj Pratap Sahi, learned counsel for the petitioner, Mr. Suresh Kumar Maurya, learned counsel for the respondent nos.2to4 and learned Standing Counsel for the State-respondents. This writ petition has been filed by the petitioner with a prayer to quash the order dated 23.08.2025 passed by respondent no.4, i.e. Block Education Officer, Vikas Khand Firozabad, District-Firozabad. Learned counsel for the petitioner submits that the petitioner was initially appointed as an Assistant Teacher at Uchchatar Prathmik Vidyalaya Nagla Parihar, Vikas Khand Madanpur, Firozabad, on 21.09.2015. Pursuant to which, he joined his services on 24.09.2015. Subsequently, the petitioner was transferred to Prathmik Vidyalaya Sofipur, Vikas Khand Firozabad, as Head Master vide order dated 08.08.2025, and joined on 18.08.2025. However, without issuing any notice or providing an opportunity to the petitioner, and solely based on direction sought from the District Basic Education Officer, the impugned order was passed, reverting the petitioner to his original post, which contravenes the principles of natural justice and the relevant Rules that mandate affording notice and opportunity to the affected party. On the other hand, learned counsel for the respondent-BSA submits that as per the Government Order dated 11.07.2013, there is no illegality or infirmity in the order impugned. However, it is assured that an opportunity of hearing will be provided to the petitioner, and appropriate orders will be Versus Counsel for Petitioner(s) : Narendra Kumar, Hritudhwaj Pratap Sahi, Sr. Advocate Counsel for Respondent(s) : C.S.C., Suresh Kumar Maurya Deepak Bansal .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) passed thereafter. In view of the aforesaid, the writ petition is allowed. The impugned order dated 23.08.2025 passed by respondent no.4 is hereby set aside. The matter is remitted to the respondent no.4 Block Education Officer, Vikas Khand Firozabad, District Firozabad, for decision afresh, on merits, in accordance with law, by means of a reasoned and speaking order, after affording an opportunity of hearing to the petitioner, expeditiously, preferably, within a period of six weeks from today, if there is no legal impediment.
