The present Writ Petition is filed questioning the non-payment of amount of Rs.3,43,122/- for hiring of JCB vehicle bearing No. AP 39 BL 7678 for 330 hours and JCB vehicle bearing No.AP 39 BR 7678 for 330 hours, totaling 660 hours @ Rs.650/- per hour and one Hitachi for 1150 hours @ 175/- per hour, for removal of boulders, cutting of hill rock area and leveling of land for the purpose of new house plots construction under the scheme “Navarathnalu Pedalandariki Illu” in the layout of Sambaiah Kandriga (Doddipalli) Village, Chittoor Mandal and District, as illegal and arbitrary. 2. Heard M/s. K.V.L. Narasimha Rao, learned counsel for the Petitioner and Sri P. Vengala Reddy, learned Standing Counsel for the Respondent No.5-Corporation. 3. At the time of hearing, the learned Standing Counsel for the Respondent No.5-Corporation passed on the instructions signed by the Commissioner of Chittoor Municipal Corporation admitting the execution of works by the writ petitioner mentioned above. It is further stated that the bills were submitted to the District Collector for payment and the Housing Department has to pay the bills. 4. As there is no dispute regarding the execution of work and the amounts due to the Petitioner and the work was executed long ago and the outstanding amounts are not high, the Writ Petition is disposed of, at the stage of admission, with the consent of both sides counsel, with the following direction: 3 (i) The Respondent authorities are directed to pay the amount due to the Petitioner within a period of two (2) months from today. There shall be no order as to costs.
