Heard the counsel for the petitioner and the A.G.A. for the State. The present petition has been filed praying for the following reliefs: "i. issue a writ order, or direction in the nature of mandamus commanding/directing the respondent no. 2 and 3 to conduct the fair investigation and conclude it within the stipulated period in pursuance of the first information report dated 21-07-2025, registered as Case Crime No. 223 of 2025, Under Section 191(2), 191(3), 115(2), 352, 351(2), 333, 309(4), 74 B.N.S. at Police Station- Shergarh, District- Mathura. ii. issue a writ order, or direction in the nature of mandamus commanding/directing the respondent no.2 and 3 to arrest the respondent no. 4 to 9, who is the named accused in the first information report dated 21- 07-2025 registered as Case Crime No. 223 of 2025, Under Section 191(2), 191(3), 115(2), 352, 351(2), 333, 309(4), 74 B.N.S. at Police Station- Shergarh, Distriet- Mathura and further to produce the progress report before this Hon'ble Court, within the stipulated period as fixed by this Hon'ble Court." There is nothing on record to show that the concerned Investigating Officer is not acting impartially and is not conducting a fair investigation. In view of the aforesaid, the writ petition is disposed of observing that in case, the petitioner has any grievance against the manner of investigation, he may file an application before the Superintendent of Police, District Versus Counsel for Petitioner(s) : Suvash Ram Counsel for Respondent(s) : G.A. Bihari Lal .....Petitioner(s) State Of U.P. And 8 Others .....Respondent(s) Mathura who is expected to ensure that investigation is done in accordance with law and as prescribed under the Code of Criminal Procedure, 1973/Bharatiya Nagarik Suraksha Sanhita, 2023.
