HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 30835 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE ARUN KUMAR, J.
1. The petitioner is aggrieved by an order dated 21.06.2022 whereby ADM (F&R), Kannauj, respondent No. 3 herein, communicated to S.D.M., Chhibramau that the claim of the petitioner for compensation under the Mukhya Mantri Krishak Durghatna Kalyan Yojna is barred by limitation as the death of her husband took place on 02.01.2021.
2. Under the Scheme, limitation of 75 days for filing claim from the date of death is provided. By Government Order dated 31.10.2023, the said time frame has been extended from 75 days to 180 days so that all claim filed up to 27.08.2022 would be treated to be within limitation.
3. Learned counsel for the petitioner submits that the impugned recommendation for rejection of the claim of the petitioner has been made without taking notice of the Government Order dated 31.10.2023.
4. Learned Additional Chief Standing Counsel fairly concedes to the said submission.
5. Consequently, the stand taken by the respondents in the impugned communication dated 21.06.2022 is held to be unsustainable in law and is quashed.
