Heard the learned counsel appearing for the parties. 2. The proceedings in this writ petition having arisen out of the notice issued to the petitioner under S.13(2) of the - 3 - HC-KAR NC: 2025:KHC:49285 WP No. 4230 of 2023 Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) and therefore, I am of the view that, the petitioner is having efficacious remedy under S.17 of the SARFAESI Act. Accordingly, reserving liberty to the petitioner to approach the competent Tribunal, the writ petition is disposed of. 3. All contentions of the parties are kept open. 4. It is submitted by the learned counsel appearing for the petitioner, that the petitioner would approach the competent Tribunal. In that view of the matter, the time spent by the petitioner before this Court be condoned under Section 14 of the Limitation Act and the respondent - Bank shall not precipitate any action against the petitioner herein, for a period of four weeks from today.
