Present applicant–Nikit Khatri S/o Shri Bharat Chand Khatri is seeking regular bail in relation to first information report dated 07.07.2025, bearing FIR No. 0085 of 2025, Police Station Kotwali Pitthoragarh, District Pitthoragarh, wherein the present applicant has been implicated for the offence punishable under Section 109(1) of the BNS, 2023. 5. It is contended by learned counsel for the applicant that the present applicant is innocent and has been falsely implicated and in fact on the date of incident, the motor-cycle of the applicant hit the informant, due to which, the informant sustained injuries. 6. Learned counsel for the applicant also submits that there is no intention to cause the incident, however, the manner, in which the allegations have been alleged in the FIR, is absolutely false and frivolous. Apart from this, he submits that due to the injuries, the informant was admitted in the hospital on 06.07.2025 and after 48 Hours, he has been discharged. Apart from this, he submits that the applicant has no previous criminal history. 7. Learned counsel for the applicant further submits that after this incident, the applicant and the informant have settled their disputes and both of them have decided to get the offence be compounded. 2025:UHC:6339 8. Mr. Piyush Tiwari, learned counsel for the complainant also submits that the complainant does not want to proceed because the applicant and the complainant have settled their dispute. 9. Ms. Pushpa Bhatt, learned AAG for the State has not raised any objection with regard to the amicable settlement of the applicant with the complainant. 10. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration the discharge certificate of the victim/complainant dated 08.07.2025, which is placed before this Court, and in view of the statement as given by learned counsel for the applicant as well as learned counsel for the complainant that the informant settled the dispute with the applicant, this Court is of the view that the applicant deserves for bail. 11. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 12. Let the applicant, namely, “Nikit Khatri,” be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
