Counsel ORDER The petitioner has filed the present writ petition seeking a writ of mandamus directing the respondents not to obstruct his right of passage through the Battai Poromboke land comprised in Survey No.786, Thanigai Polur Village, so as to enable him to have free access to his agricultural lands comprised in Survey Nos.28/3B, 28/4B and 29/4B, situated at Uliyambakkam Village, Arakkonam Taluk. 2. According to the petitioner, he is the owner of the aforesaid agricultural lands. It is his case that, from time immemorial, he has been using the land in Survey No.786 as a cart track to reach his property. However, respondents 2 and 3 are allegedly preventing him from using the said pathway. 3. The learned Government Advocate, on instructions, submitted that the land in Survey No.786 is classified as “Battai Poromboke” (pathway) in the revenue records, namely the ‘A’ Register. 4. Once it is admitted by the respondents that Survey No.786 is classified as a Battai Poromboke, the said land is meant to be used as a public pathway. Consequently, the petitioner is entitled to use the said pathway for ingress and egress to his agricultural lands, subject to the rights of other users. https://www.mhc.tn.gov.in/judis

In view of the above admitted position, respondents 2 and 3 cannot obstruct the petitioner from using the pathway comprised in Survey No.786 to access his lands. 6. Accordingly, the writ petition is disposed of with a direction to respondents 2 and 3 not to interfere with or obstruct the petitioner’s use of the Battai Poromboke in Survey No.786 as a pathway to reach his lands comprised in Survey Nos.28/3B, 28/4B and 29/4B. 7.
