The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus for issuance of directions to the respondents to grant the benefit of Dearness Allowance/Dearness Relief to the employees retired during the period from January, 2020 to June, 2021 @ 21% w.e.f. 01.01.2020, @ 24% w.e.f. 01.07.2020, @28% w.e.f. 01.01.2021 in accordance with the instalments granted to the Central Government Employees vide Office Memorandum dated 07.09.2021 (Annexure P-14). 2. Learned counsel for the petitioners submits that he would be satisfied if the representations (Annexures P-15 & P-16) of the petitioners are decided by the respondents by passing a speaking order in a time bound manner. 3. Learned State counsel, appearing on advanced notice, submits that he has no objection in case a direction is issued to the respondents for time- bound consideration and decision of the representations of the petitioners by Neha 2025.08.21 13:34 I attest to the accuracy and integrity of this document CWP-24008-2025 -2- passing a speaking order. 4. Therefore, in view of the limited prayer made by learned counsel for the petitioners, the respondents are directed to consider the representations (Annexures P-15 & P-16) of the petitioners and pass a speaking order, after affording them an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by the respondents. 5. Disposed of, accordingly.
