Nawaz for the petitioner Sajidul Islam who has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Mankachar Police Station Case No. 28/2025 under Sections Page No.# 2/3 61(2)/319(2)/318(4)/336(3)/339 of the BNS. 2. Heard Mr. K. K. Das, learned Additional Public Prosecutor, Assam. 3. Learned Additional Public Prosecutor has raised serious objection against the bail petition stating that there are incriminating materials in the case diary against the petitioner. 4. The petitioner is deeply involved in the offence and he is the owner of the shop. The FIR unfolds that an information was received that Zamir Hussain is engaged in manufacturing fake Pan cards and the investigating team went to his house. On being confronted, Zamir Hussain admitted that he applied for several Pan cards online from his own house. On raiding his house, 20 Pan cards in sealed envelopes were recovered along with other items mentioned in the seizure memo. The names and addresses of the individuals of 20 Pan cards were fake as admitted by Zamir Hussain. 5. He further disclosed that the present petitioner used to provide the names and addresses along with photographs of the individuals, which were then forged and the Pan cards were manufactured. Thereafter, Zamir Hussain would upload these details on the Government Pan application portal using his laptop. After uploading the same, the Pan cards were sent via postal service to the house of the present petitioner and the petitioner would dispatch the Pan cards to different locations across India. The shipments were made under the name of Ayan Mobile Shop, owned by the present petitioner at Thakuranbari. 6. I have also scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the present petitioner. 7. The petitioner is involved in a serious offence and his network reaches throughout different states of India. Page No.# 3/3 8. It appears that the investigation may be adversely affected if the petitioner is insulated by an order of pre-arrest bail. 9. At this juncture, I am not inclined to grant bail to the petitioner. 10. Petition with prayer for pre-arrest bail stands rejected at this stage. 11. Send back the Case Diary. JUDGE Comparing Assistant
