POONACHA ORAL JUDGMENT (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The present appeal was dismissed by virtue of the order dated 29.04.2025 as the appellant failed to cure the office objections despite several opportunities. One of the objections raised was that the appeal was filed after an inordinate delay of 325 days. However, no application had been filed by the appellant seeking condonation of the delay in filing the said appeal. 2. This Court is also informed that the appellant has now filed an application seeking condonation of delay in filing the appeal. However, other objections have not been cured as yet. Concededly, the explanation for delay set out in the application for condonation of delay filed by the appellant is in similar terms as in the application in W.A No.1803/2024 (IA No.1/2025 in WA - 3 - HC-KAR NC: 2025:KHC:54121-DB WA No. 1805 of 2024 No.1803/2024). We have dismissed the said appeal as the court had found no infirmity in the impugned order as well as no ground to condone the delay. Thus, the present appeal is also liable to be dismissed. 3. In the present case, the application for recall of the order dated 29.04.2025 is allowed. However, the appeal is dismissed both on account of delay as well as on merits for the reasons set out in the order passed today in WA No.1803/2024. 4.
