For Petitioner(s): Mr.Vishnu V.R. for Ms.V.Srimathi For Respondent(s): Mr.C.Prabakaran, Government Counsel for R1 to R5 Mr.Dominic S.David, Government Counsel for R6 to R8 Order This Writ Petition has been filed to direct the respondents to dispose the petitioners representation dated 27.02.2025 to classify the lands as Ayan Patta Land. 2. The learned counsel for the petitioner submitted that the petitioner is the absolute owner of the properties in R.S.F.No.16/1, corresponding to the old S.F.No.59A of Nichampalayam Village, Perundurai Taluk, Erode District, by https://www.mhc.tn.gov.in/judis WP No. 17456 of 2025 __________ Page3 of 6 virtue of two Sale Deeds dated 29.08.2001. When the petitioner perused the revenue records, the said properties were found to be classified as ‘Conditional patta’ in the village revenue records. However, the encumbrance certificate pertaining to the said lands does not show any condition attached to the land. Hence, there is no other reliable material to show that the lands in R.S.No.16/1 are conditional patta lands. The respondents have erroneously classified the petitioner’s land in R.S.No.16/1 as conditional patta. Consequently, the petitioner submitted a petition dated 27.02.2025 to the respondents to classify the lands as ‘Ayan patta land’ by removing the condition, if any in existence, and also by correcting the errors that occurred during the resurvey, thereby transferring the patta of the said land to the petitioner’s name in pursuance of his title deeds. Since the said petition has not been disposed of to date, the petitioner has approached this Court. 3. In reply, the learned Government Counsel appearing for the respondents 1 to 5 submitted that the petitioner’s representation/petition dated 27.02.2025 will be disposed of by the 5th respondent within a period of six weeks. 4. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record. https://www.mhc.tn.gov.in/judis WP No. 17456 of 2025 __________ Page4 of 6 5. In view of the above, this Court without going into the merits of the matter, directs the 5th respondent to consider the petitioner’s representation/petition dated 27.02.2025 on its own merits and dispose of the same in accordance with law within a period of six weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and shall afford him with an opportunity of personal hearing. 6.
