Heard the parties.
The petitioner has been made accused in connection with Sessions Trial No. 118 of 2024 arising out of R.I.T. P.S. Case No. 20 of 2024 (M.C.R.A.274 of 2025), for the offences registered under Sections 302, 201, 34 of the I.P.C. and charge sheet has been submitted under Sections 302, 201, 411, 471, 379 of the I.P.C., pending in the Court of learned Sessions Judge, Seraikella- Kharsawan. Bail application of the petitioner was earlier rejected by this court vide B.A. No.10593 of 2024 by order dated 16.12.2024. During the intervening period of 25/26.02.2024, a labourer staying in the house of the informant namely Sonaram Kerai was murdered by unknown persons. It appears that he was strangulated by a belt and also his head was crushed by a stone. During the course of investigation, the petitioner has confessed his guilt and on the basis of his confession, the stone used in crushing the head of the deceased and the belt used in strangulating him were recovered.
Learned counsel for the petitioner submitted that prosecution has examined two witnesses but they have not supported the prosecution. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
