ORDER The present petition has been filed by the second accused in C.C.No. 1428 of 2020, on the file of the Judicial Magistrate No.II, Trichy, seeking to quash the charge sheet, wherein the petitioner along with other accused have been charged with the offences under Sections 457 and 380 of IPC.
2. A perusal of the records reveal that the second respondent authority had seized the vehicle for the tax dues and the vehicle was parked in the Trichy West RTO office on 30.12.2018. At about 12.00 midnight, on 31.12.2018, the first accused, who is the driver of the omnibus, along with his brother, who is the second accused, have broken open the lock of the RTO Office and operated the bus and committed theft of the bus.
3. According to the learned counsel appearing for the petitioner, the petitioner/second accused is no way connected with the said offence and he has been falsely implicated. 2/5 https://www.mhc.tn.gov.in/judis

4. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

It could be seen from the charge sheet, the second accused, who is the brother of the first accused, has accompanied the first accused and had helped him in moving the vehicle from the premises of the RTO Office. In such circumstances, specific overt acts are alleged as against the petitioner herein and there are no grounds to quash the charge sheet.
6. In view of the above said facts, there are no merits in this petition. Accordingly, this Criminal Original Petition is dismissed. Consequently connected Miscellaneous Petitions are closed.
