GP FOR PROHIBITION EXCISE The Court made the following: THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO.5258 OF 2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “..to issue a Writ, Order or Direction particularly one in the nature of writ of Mandamus a declaring the action of the respondents in measuring the distance between the petitioner liquor shop premises and Sri Ramana Maharshi Aided School Proddatur in a manner not prescribed under the Andhra Pradesh Excise Grant of license of selling by shop and conditions of license Rules, 2024 diverging from the manner adopted across the state as unreasonable, illegal and arbitrary (b) declaring the action of the respondents in directing the respondent not to conduct sales and to shift the liquor shop from the premises situated at D.No.7/781 Beside SS Complex Korrapadu Road, Proddatur, YSR Kadapa District after permitting the petitioner to commence the business operations after due verifications without issuing any valid notice as illegal and arbitrary besides being violative of Article 14 of the Constitution of India and also violation of principles of natural justice (c) and consequently direct the respondents to measure the legally recognized pathway distance between the petitioners wine shop and the Sri Ramana Maharshi Aided School Proddatur instead of random airway and permit the petitioner to run the liquor shop situated at D.No.7/781 Beside SS Complex, Korrapadu Road, Proddatur, YSR Kadapa District and pass such other order or orders…” 2. Heard learned counsel for the petitioner. 3. Learned counsel for the petitioner submits that pending writ petition, the respondents are taking steps to relocate the subject shop. Hence, the relief claimed by the petitioner is redressed by the respondents. As such, learned counsel of the petitioner seeks permission of this Court to withdraw the present writ petition. 4. Permission as sought for is accorded. 5. Accordingly, the Writ Petition is dismissed as withdrawn. No costs.
