Heard learned counsel for the applicants/petitioners and perused the record. 2. This writ petition has been filed seeking following relief :- "i). Pass an order directing to the Civil Judge Senior Division Kushinagar to decide the case as case no.314/24 (Jay Prakash Chaurasiya and others Vs. Sayda Khatun and others), within stipulated period." ii). The Hon'ble Court may be pleased to pass and order directing to the Civil Judge (S.D.), Kushinagar to decide the misc. Application dated 9.7.2025 (Paper No.19 Ga) in the Civil Suit No.314/2024 (Jay Prakash Chaurasiya and others vs. Sayada Khatun and others) within stipulated period as fixed by this Hon'ble Court pending in the Court of Versus Counsel for Petitioner(s) : Baijant Kumar Mishra, Manoj Kumar Tripathi Counsel for Respondent(s) : Jay Prakash Chaurasiya And 4 Others .....Petitioner(s) Sayda Khatun And Another .....Respondent(s) Civil Judge (S.D.), Kushinagar. 3. Learned counsel for the petitioner submitted that the above- mentioned application is pending consideration since 2024 and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned application is pending, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to the Civil Judge (Senior Division), Kushinagar to decide the above-mentioned application, in accordance with law, expeditiously, preferably within twelve weeks from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
