In view of the above, the present petition is allowed and impugned order dated 08.02.2019, passed by Principal District Judge Anantnag, in an application preferred by the petitioner, for leave to defend the suit (File No. 15/M) in case titled “Mohammad Saieem Ganaie vs. Tariq Ahmad Wani”, to the extent of imposition of condition to deposit 30% of the suit amount is set-aside.
