J.(Oral) This petition seeking for quashing of order dated 27.02.2023 has been filed on the ground that the petitioner was never served with any notice and that he never appeared before the trial Court nor jumped the bail and that without adopting the due process he has been declared a proclaimed person. The record shows that the petitioner is not a bail jumper and the offence for which he had been called to stand trial, by the trial Court, is bailable in nature. Even, if he has been declared proclaimed person, the VIPIN KUMAR 2025.08.25 20:16 I attest to the accuracy and integrity of this judgment/order CRM-M-46303-2025 2 offence still remains a bailable offence and the trial Court is duty bound to admit him to bail as and when he surrenders before the learned trial Court. In view of above mentioned observations, no cause for survival of this petition exists. Hence, the same is ordered to be dismissed with liberty to the petitioner to surrender before the learned trial Court and seeks remedy in accordance with law.
