This application has been filed with a prayer to grant anticipatory bail to the applicant in Case Crime No. 188 of 2008, under Sections 147, 148, 149, 307, 323, 332, 336, 353, 427, 436 IPC, Section 7 Criminal Law (Amendment) Act, Section 3 Public Property Damages (Prevention) Act and Section 150/151 Indian Railway Act, Police Station- Rasoolpur, District- Firozabad. 2. At the outset, Sri Neeraj Kumar Sharma, learned A.G.A. for the State submits that the applicant had earlier preferred an application under Section 528 BNSS numbered as 6185 of 2025 (Amir Khan vs. State of U.P. and another) for quashing the charge sheet dated 30.05.2008 as well as the proceedings of Sessions Case No. 2180 of 2019 (State Vs. Ajeem Bhai & others) of the aforementioned case. The application was disposed of vide order dated 17.06.2025 with a direction to the court concerned that in case, the applicant surrenders before he court concerned within a period of three weeks from that date and applies for bail, his bail application shall be considered and decided expeditiously in accordance with law. Further, for a period of three weeks from that date, the applicant was granted protection by this Court. Learned AGA submits that the said fact has not been disclosed in Versus Counsel for Applicant(s) : Vinay Kumar Counsel for Opposite Party(s) : G.A. Amir Khan .....Applicant(s) State Of U.P. And Another .....Opposite Party(s) the present application. The present application is liable to be dismissed on this ground alone. 3. At this stage, Sri Vinay Kumar, counsel for the applicant prays for withdrawal of the present application. 4. Accordingly, the application is dismissed as withdrawn.
