Heard Sri Abhishek Singh, learned counsel for the petitioner and Sri Pankaj Kumar, learned A.G.A. appearing for the State respondents. 2. The relief sought in this petition is for quashing of the F.I.R. dated 4.11.2024 registered as Case Crime No. 240 of 2024, under Sections 303(2), 3(5), 112, 61(2) of B.N.S., Police Station Gagalheri, District Saharanpur. Further prayer has been made not to arrest the petitioner in the aforesaid case. 3. Certified copy of the first information report has been been filed along with present petition and admittedly, the petitioner is not named in the first information report. 4. We find that the present petition is not maintainable in the light of judgment of Hon'ble Apex Court passed in SLP (Criminal) No. 762 of 2020 (Hukum Chand Garg and others vs. State of U.P. and others) decided on 7.2.2022. 5. In such view of the matter, present petition is not maintainable on behalf of the petitioners and the same is accordingly dismissed as not maintainable.
