2025:JHHC:16260 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3009 of 2025 ------- Rajesh Kumar, aged about 33 years, son of Devnandan Prasad, resident of Banta Nagar, P.H.D. Colony, Adityapur-2, Road No.33, P.O. & P.S. R.I.T., District Seraikella-Kharsawan. …... …. Petitioner(s) Versus The State of Jharkhand .…. …. Opp. Party -------- CORAM : HON’BLE MR. JUSTICE AMBUJ NATH -------- For the Petitioner(s) : Mr. Jitendra Nath Upadhyay, Advocate For the State : Mr. Bishambhar Shastri, A.P. P. -------- 03/ Dated 20.06.2025 Heard the parties. The petitioner has been made accused in connection with R.I.T P.S. Case No. 12 of 2024, S.T. Case No.82 of 2024 (MCRA No.284 of 2025), for the offence registered under Section 302 of the Indian Penal Code and charge framed under Sections 302/201 of the Indian Penal Code, pending in the court of learned Sessions Judge, Seraikella-Kharsawan. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.6322/2024, by order dated 06.08.2024. It is alleged that petitioner had assaulted his wife by hammer, due to which, she succumbed to her injuries. Report regarding the stage of the trial and the time required for its conclusion, earlier called for, has been received. It appears that out of ten witnesses, seven witnesses have already been examined and the trial is likely to be concluded within four months. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail is hereby rejected. Learned Trial Court shall expedite the trial and preferably conclude the same within four months from the next date fixed for recording of evidence. (Ambuj Nath, J.) BS/-
