Ms. Manju Chauhan, learned counsel holding the brief of Mrs. Prabha Naithani, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. The present applicant ‘Ranjeet @ Rajat Kashyap’ S/o Ram Saran is praying for bail in relation to First Information Report dated 04.06.2025 bearing FIR No. 267 of 2025 P.S. Patel Nagar, District Dehradun against unknown person for the offence punishable under Section 304 of BNS, 2023. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and have no previous criminal history and furthermore the recovery is from the co-accused. 5. Apart from this, she submits that the applicant has been implicated for the offences punishable under Sections 304(2), 317(2) and 3(5) of BNS, 2023, and is languishing in jail since 04.06.2025 and all the offences are triable by Magistrate. 6. On the other side, learned A.G.A. Mr. Sandeep Sharma have not disputed this fact that the offences in which the applicant has been implicated are triable by Magistrate. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that all the offences are triable by the Magistrate, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Ranjeet @ Rajat Kashyap’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned. 2025:UHC:6373 10. It is made clear that after being released on bail the present applicant shall report to the nearest police station in every 15 days and the concerned SHO shall record his presence, failing which the prosecution is free to move an application for cancellation of his bail.
