BEFORE HONOURABLE MR. JUSTICE SUMAN SHYAM ORDER Date : 19-03-2025 Heard Mr. A.K. Kanu, learned counsel for the writ petitioner. Also heard Ms. S. Baruah, learned CGC appearing for the respondents. The petitioner’s case, in a nutshell, is that pursuant to the advertisement notice
Page No.# 3/4 dated 21-07-2018, he had participated in the recruitment process for appointment of Constables (GD) in the Central Armed Police Forces (CAPFs), NIA, SSF and Rifleman (GD) in the Assam Rifles constituting around 54953 number of vacancies. The writ petitioner belongs to the OBC category. The grievance of the petitioner is that although he has scored higher marks than the unreserved category candidates, yet, he has not been appointed. Hence, this writ petition. Responding to the prayer made in the writ petition, Ms. Baruah, learned CGC submits that there is no merit in the plea raised in the writ petition. Moreover, the selection process pertains to the year 2018 and on conclusion of the said process, all the vacancies have already been filled up.
The learned CCC has also invited the attention of this Court to the judgment and order dated 23-10-2024 passed by this Court in W.P.(C) No. 4425/2024 whereby, similar writ petition had been dismissed on the ground of delay in approaching the Court. I have perused the order dated 23-10-2024. After going through the materials available on record and keeping in mind the requirement to maintain uniformity in judicial orders, this Court is of the opinion that the present writ petition is also liable to be dismissed on the ground of delay as there is no plausible explanation for the delay in the writ petition Consequently, the writ petition stands dismissed.
