The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 58/2025, registered at Police Station – Bhatapara Gramin, District – Balodabazar (C.G.) for the alleged commission of offence punishable under Sections 109(1), 296, 351(2) and Section 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. According to the prosecution's story, it is alleged that a tussle ensued between the applicant and the complainant while the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.02.19 11:47:03 +0530 2 applicant was making a video on his mobile phone regarding the broken CCTV camera at his uncle's house. Consequently, an FIR was registered against the applicant and other co-accused persons under Sections 109(1), 296, 351(2), and 3(5) of BNS, 2023. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the applicant has 03 criminal antecedents and all cases have already been closed. He further submits that the applicant was trying to make video in hi mobile, therefore, in order to take revenge from him, he has been falsely implicated in the present case. He submits that the applicant is a young college student, approximately 20 years old, and if he is incarcerated, it will have an adverse effect on his future, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant and submits that the present applicant along with other co-accused person assaulted the injured by knife due to which the injured received grievous injuries, therefore, the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and material on record in the case diary, it appears that the present applicant along with other co-accused person assaulted the injured by knife due to 3 which the injured received grievous injuries, therefore, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Badal Verma, involved in Crime No. 58/2025, registered at Police Station – Bhatapara Gramin, District – Balodabazar (C.G.) for the alleged commission of offence punishable under Sections 109(1), 296, 351(2) and Section 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected.
