PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2110 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/Accused No.3, seeking regular bail, in Crime No. 489 of 2024 of Kancharapalem Police Station, Visakhapatnam District registered for the offence punishable under Sections 143(2), 127(2) r/w 3(5) BNS, Sections 3(1), 4(1), 5(1)(a), 6(3)(a) of PIT Act. 2. Case of the prosecution, in brief, is that, this is a case of trafficking women, for the purpose of engaging them in prostitution. On 30.12.2024 at about 12.00 hours, on receipt of credible information with regard to organized prostitution held at the house bearing No. D.No. 39-6-32/3, behind Passport Office, Muralinagar, Visakhapatnam, the Sub-Inspector of Police, Kancharapalem Police Station along with his staff and mediators rushed to scene and with the help of women staff, knocked the door, one woman opened the door and then, they entered the house, verified and found two women in a bedroom and another woman crying. On enquiry, they identified the three women to be victims and A1 to A3 are the organizers of the brothel house and rescued one woman and seized two android mobiles under the cover of mediators report. Consequently a case has been registered against the accused. 3 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. Learned Counsel for the petitioner would submit that the petitioner has been in judicial custody since 30.12.2024. Learned Counsel would further submit that the remaining accused were released on bail. By this time, investigation might have completed. The petitioner is ready to furnish the sureties to the satisfaction of the Court. Learned Counsel for the petitioner finally prays to allow the petition. 5. Learned Assistant Public Prosecutor vehemently opposed the petition and would submit that the petitioner was caught while organizing the illegal prostitution. The Police found three women and they were lured into the prostitution. The other accused who are released on bail are the customers. Learned Assistant Public Prosecutor would further submit that the investigation is at crucial stage and accordingly, prays for dismissal of the petition. 6. Considering the submissions made and a fair look at the material placed on record, the petitioner alleged to have been maintaining illegal prostitution house with some women. As rightly put by the learned Assistant Public Prosecutor, investigation is at crucial stage, if the petitioner is released at this stage, there is every likelihood of influencing the victims and witnesses in this case. Hence, this Court is not inclined to release the petitioner on bail at this stage. 4 7. Accordingly, the Criminal Petition is dismissed.
