Instant petition was decided on 21.07.2025 with the directions to the respondent authority to decide the representation dated 13.05.2025 of the petitioners. In the representation that was given by the petitioners, which is Annexure No.7 to the writ petition, it has been alleged that the respondent no.7 had encroached on a public pathway. Now, a recall application has been filed by the respondent no.7 on the ground that there is a civil suit pending between the parties and if any action is done by the respondent authorities pursuant to the directions of this Court, it may adversely affect the interest of the respondent no.7. Learned counsel for the respondent no.7 would submit that with regard to the Chak road, there is no order of any civil court. Having heard, this Court is of the view that the effect and the operation of the final order dated 21.07.2025 may be kept in abeyance till the recall application is decided. The petitioners may file objections to the recall application within three weeks.
