This writ petition has been filed for following relief:- "It is, therefore, most respectfully prayed that this Hon'ble court may graciously be pleased to direct the Additional District Judge, Court No. 7, Mathura to decide the Misc. Civil Appeal No. 29 of 2023 (Swami Darshanand Vs. Sri Prakashanand and others) within stipulated and reasonable period as fixed by this Hon'ble Court otherwise petitioner shall suffer irreparable loss and injury." 3. Contention of learned counsel for the petitioner is that civil appeal is pending since 2023 and he prayed that same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Additional District Judge, Court No. 7, Mathura to consider and decide the appeal, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after giving opportunity of Versus Counsel for Petitioner(s) : Anemash Kumar Kushwaha, Arvind Kumar Verma Counsel for Respondent(s) : Krishna Nanad .....Petitioner(s) Swami Darshanand Pupil Brahmanand Bhuri Wale And 4 Others .....Respondent(s) hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
