ORAL ORDER
1. This petition is filed by accused No. 2 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (hereinafter referred to as the `BNSS’) praying to grant bail in crime No. 121/2025 of Devanahalli Police Station registered for offences under Section 107, 3(5) of Bharatiya Nyaya Sanhita (hereinafter referred to as the `BNS’).
2. Heard Learned counsel for petitioner and Learned HCGP for respondent State.

Learned counsel for petitioner would contend that the petitioner is the grandmother of the deceased and accused No. 1 is the father of the deceased. As per averments of the complaint on 12.09.2025, accused Nos. 1 and 2 are stated to have abused the deceased in filthy words and asked her to go and die. Except the said allegation there is no other allegation against the

petitioner. The petitioner was not present on 13.09.2025 and 14.09.2025 in the house of the deceased. The deceased committed suicide on 14.09.2025. On that day, accused No. 1 is stated to have abused the deceased. Whether the act of this petitioner abusing and asking the deceased to go and die amounts to abetment to commit suicide is a matter of investigation and trial. The petitioner is a woman and as major portion of the investigation is over she is not required for further custodial interrogation. With this he prayed to allow the petition. 4. Per contra learned HCGP would submit that in the voluntary statement this petitioner has admitted of she and accused No. 1 scolding the deceased, suspecting her behaviour, talking over the phone laughingly etc. The mobile of the deceased has been seized and it has been sent to FSL for examination. The offence alleged against the petitioner is provided with punishment of imprisonment which may extend to 10 years. Investigation is in progress. With this he prayed to reject the petition. - 4 -

5. Having heard the learned counsel for the parties this Court has perused the FIR, complaint and other materials placed on record. 6. The deceased is the daughter of accused No. 1 and complainant. Petitioner - accused No. 2 is the grandmother of the deceased and mother of accused No.
1. The deceased was aged 17 years and she was studying in II PUC. She was residing with accused No. 1 and the complainant.
It is alleged that on 12.09.2025 petitioner came to the house of her son – accused No. 1 and when they were talking regarding family matters they quarreled with the complainant and the deceased, abused complainant, deceased and son of the complainant in filthy words, telling that they will not listen to them and they will only listen to the words of mother and they are waste bodies and asked them to go and die. The deceased committed suicide on 14.09.2025. The averments do not indicate the presence of petitioner in the house of deceased on 14.09.2025. On 14.09.2025 also accused No.

1 is stated to have abused the deceased and asked her to go and die and on the same day she has committed suicide. Whether the act of the petitioner abusing the deceased and asking her to go and die amounts to abetment to commit suicide or not is a matter of investigation and trial. The petitioner is a woman aged 71 years and is in custody since 16.09.2025. Major portion of the investigation is over. The petitioner is not required for custodial interrogation. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. 7. In the result of following;
O R D E R
Petition is allowed. Petitioner is granted bail in crime No. 121/2025 of Devanahalli Police Station subject to following conditions:

I. Petitioner shall execute a personal bond for the sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the jurisdictional Court. II. Petitioner shall not tamper the prosecution witnesses either directly or indirectly. III. Petitioner shall cooperate in further investigation, if any. IV.
