As can be seen from the aforementioned allegations, the allegation against accused Nos.1 and 2 (petitioners herein) is that accused No.1 by cheating, took the original sale deed pertaining to the property which belonged to the complainant(respondent No.2 herein) and thereafter, by creating a forgery, got a general power of attorney created in favour of his wife, accused No.2 and both accused Nos.1 and 2 have subsequently had transactions with regard to the property and have presently sold the same in favour of accused Nos.3 to 5. 4. 4. The case of the petitioners/accused Nos.1 and 2 is that insofar as it relates to the allegations against them, respondent No.2 (complainant herein) initially filed a private complaint and after reference to the jurisdictional - 8 - HC-KAR NC: 2025:KHC:46591 CRL.P No. 6863 of 2019 police, a FIR came to be registered on 20.03.2009 in Crime No.71/2009. However, after investigation, a 'B' report came to be filed in the said case and the same has been accepted by the Court. It is submitted that it is not open for respondent No.2 to once again make a complaint against the petitioners herein in respect of the same offence and the police cannot take up the same for investigation and the filing of a police report against the petitioners herein amounts to double jeopardy. 5. In spite of service of notice, respondent No.2- complainant has remained absent. 6. The learned High Court Government Pleader, upon instructions, fairly submits that respondent No.2- complainant had initially filed a private complaint against the petitioners herein and it resulted in filing of a 'B' report after due investigation. 7. The petitioners in the instant petition are charged with the offences under Sections 120B, 447, 465, - 9 - HC-KAR NC: 2025:KHC:46591 CRL.P No. 6863 of 2019 466, 467, 468, 471 and 420 of the Indian Penal Code, 1860 (for short, 'the IPC'). All the offences pertain to cheating and forgery, which were the subject matter of the private complaint in which a 'B' report has been filed against the petitioners herein and it has attained finality. The other offences mentioned in the charge sheet are in respect of trespass and criminal intimidation, which is alleged against the other accused and not the petitioners herein. 8. Generally, multiple FIRs cannot be permitted to be filed against the same person. If the same is allowed, it would result in the accused getting entangled in multiple criminal proceedings for the same alleged offence. Therefore, the registration of such multiple FIRs is nothing but abuse of the process of law. The act of registration of such successive FIRs on the same set of facts and allegations, at the instance of the same informant under the present facts and circumstances of the case cannot be sustained. - 10 - HC-KAR NC: 2025:KHC:46591 CRL.P No. 6863 of 2019 9. In the course of the proceedings, it is brought to the notice of this Court by the learned High Court Government Pleader that there are civil suits pending between respondent No.2-complainant and the petitioners herein. That cannot be a ground for sustaining the criminal proceedings against the petitioners herein when they are otherwise not sustainable. However, it is hereby clarified that quashing the criminal proceedings against the petitioners herein will not come in the way of respondent No.2 continuing a civil proceedings against the petitioners and the Court will have to consider the matter based on the pleadings and the evidence let in over therein irrespective of the outcome of the criminal proceedings. 10. Hence the following: ORDER i. The Criminal Petition is hereby allowed. ii. The proceedings in C.C.No.18486/2019 (Crime No.355/2018), pending on the - 11 - HC-KAR NC: 2025:KHC:46591 CRL.P No. 6863 of 2019 file of IX Addl.Chief Metropolitan Magistrate, Bangalore, insofar as it relates to the petitioners herein, are concerned, stand quashed.
