S.K.Pal, learned Additional Chief Standing Counsel. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for quashing of the order of suspension dated 01.08.2025 on certain allegation. 3. It is submitted that petitioner was earlier served with the charge sheet in respect of the same allegations to which he submitted detailed reply and after the inquiry report has been submitted and show cause notice was issued to the petitioner he has already offered his explanation. Under the circumstances it is contended that when the disciplinary authority is not able to complete the matter of disciplinary proceedings, petitioner cannot be forced to continue under prolonged suspension. 4. Per contra it is argued by learned Additional Chief Standing Counsel that since the final report has been submitted in the matter of disciplinary proceedings and petitioner has already offered his explanation in reply to the show cause notice, the ends of justice would get served if the disciplinary proceedings is directed to be concluded in accordance with law within the time bound period. 5. In such above view of the matter I dispose of this petition with direction to the disciplinary authority to conclude the disciplinary proceedings by passing final order after considering the explanation Versus Counsel for Petitioner(s) : Ajay Kumar Srivastava, Anand Priya Singh Counsel for Respondent(s) : C.S.C. Krishna Kumar .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) offered by petitioner in reply to the show cause notice, as expeditiously as possible, preferably within a period of 30 days of production of certified copy of this order. 6. It is clarified that since the departmental inquiry has already been concluded, in such circumstances the disciplinary proceedings are not completed within the time bound period as prescribed hereinabove, despite cooperation to be rendered by petitioner, the order of suspension dated 01.08.2025 shall ceased to operate resulting in reinstatement of petitioner with pay.
