05/ 09.06.2025
Heard the parties at length.
2.
This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Balidih P.S. Case No.295 of 2024, for offences under Sections 406 and 420 IPC. The case is presently pending before the Court of learned SDJM, Bokaro.
3.
The allegation against this petitioner is of extorting money on the pretext of giving employment and thereafter not returning the money.
4.
During the course of argument, learned A.P.P. representing the State after taking specific instructions, submitted that thrice notice under Section 41(A) Cr.P.C. / 35(3) of the BNSS (20.10.2024 till 13.01.2025), was issued to the petitioner but the petitioner did not appear before the concerned Police.
5.
The aforesaid fact clearly suggests that the petitioner is not cooperating with the investigation. Thus, I am not inclined to grant anticipatory bail to this petitioner.
6.
Accordingly, this Anticipatory Bail Application stands dismissed.
