Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. The petitioner by means of the present writ petition has prayed for a direction to the respondent authorities to take appropriate action in pursuance of the notification dated 16.1.2025 issued by State Government for drains construction in Ward No.9, Nagar Panchayat Ghughli, District Maharajganj under the Sewerage and Water Discharge Scheme in financial year 2024-25, within a stipulated period as fixed by this Court. 3. It is contended on behalf of the petitioner that the respondent nos. 5 to 7 have encroached upon certain land belonging to the Nagar Panchayat and, in such view of the fact, the relief as prayed for may be granted. 4. It has come on record that the Nagar Panchayat has already initiated proceedings under law against respondent nos. 5 to 7 for encroachment upon its land, and notices dated 02.06.2025 and 03.07.2025 have already been issued in this regard. 5. Since the Nagar Panchayat has already initiated proceedings against the respondents no. 5 to 7 for illegal encroachment of the land of Nagar Panchayat, therefore, we are of the view that the Versus Counsel for Petitioner(s) : Yogesh Kumar Tripathi Counsel for Respondent(s) : C.S.C. Roshni Jaiswal .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s) petitioner has no locus standi to file the present writ petition. 6. Accordingly, the writ petition stands dismissed.
