Dixit, learned Additional Chief Standing Counsel for the respondents No. 1 to 3 & 6 and Sri Gaurav Kumar Chaturvedi, learned counsel for the respondent No.4. 2. The petitioner by means of the present writ petition has prayed for the following reliefs:- "(i). Issue a writ, order or direction in the nature of mandamus commanding the respondents to immediately remove the filth, sludge and muck dumped in front of the petitioner's residence and on the public road, and restore hygienic and sanitary conditions in Ward No.2, Nagar Panchayat, Khetasrai, District Jaunpur in the interest of public health. (ii). Direct the respondent No.2 (District Magistrate, Jaunpur) and respondent No.4 (Executive Officer, Nagar Panchayat, Khetasarai) to take immediate preventive and remedial measures for sanitation and public health in the locality, particularly in view of the monsoon rains so as to prevent outbreak of malaria, dengue, cholera and other epidemic diseases. (iii). Direct the respondent No.2 (District Magistrate, Jaunpur) to decide the detailed representation submitted by the petitioner (Annexure No.4) dated 29.07.2025 within a fixed and reasonable period, by passing a reasoned and speaking order, strictly in accordance with law. (iv). Direct initiation of enquiry/investigation under the supervision of the District Magistrate, Jaunpur against the respondent No.7 (Ward Councillor, Mr. Khalid son of Badruddin) and any other guilty officials found responsible for arbitrary dumping of sludge and misuse of authority and to submit a compliance/action taken report before this Hon'ble Court. Direct initiation of appropriate penal and disciplinary proceedings against the respondent No.7 (Ward Councillor) and all other delinquent officers/officials under relevant provisions of the B.N.S. (2023), the Prevention of Damage to Public Property Act, 1984 and the Municipal Acts/Rules in force. (vi). Direct recovery of costs/damage from the respondent No.7 for the loss caused to the petitioner (including damage to private bricks and expenses of medical treatment of family members) so that the public officials are deterred from abusing their authority. (vii). Direct the respondent No.3-Chief Medical Officer, District Jaunpur to conduct immediate health inspection and take preventive measures against outbreak of malaria, dengue and other epidemic diseases in the locality. (viii). Award cost to humble petitioner throughout of the writ petition. (ix). Pass such other order or direction as this Hon'ble Court may deem just and proper in the facts and circumstances of the case to secure the ends of justice." 3. Sri V.K. Dixit, learned Additional Chief Standing Counsel, on instructions, states that the filth, sludge and muck dumped in front of the petitioner's residence has been removed and has been sanitized and the fogging has also been done. Relevant extract of the letter of the Chief Medical Officer, Jaunpur to the District Malaria Officer, Jaunpur dated 30.08.2025 is reproduced herein below:- "पत्रांकः मु०िच०अ०/ कोटर् के स/िनयाज अहमद/ 2025-26/13359-61 िदनांकः 30 अगस्त 2025 1. िजला मलेिरया अिधकारी, जौनुर । 2. अधीक्षक सामु० स्वा० के न्द्र सोंधी जौनपुर । 3. कायर्पालक अिधकारी, नगर पंचायत खेतासराय, जौनपुर । िवषय वाडर् नं०-2 नगर पंचायत खेतासराय में कचरा गंदगी एवं कीचड हटाने तथा स्वच्छता बहाली के सम्बन्ध में। उपरेक्त िवषयक श्री कु माल रिव िसह, मुख्य स्थायी अिधवक्ता, मा० उच्च न्यायालय इलाहाबाद के पत्र िदनांक -29 अगस्त 2025 एवं िजलािधकारी जौनपुर महोदय के पृष्ठांकन आदेश िदनांक-30.08.2025 (िसिवल िरट यािचका नोिटस संख्या-A202501-4989/2025 िनयाज अहमद बनाम स्टेट ऑफ यू०पी० व अन्य) के सन्दभर् में सूिचत करना है िक उक्त वाडर् में स्वच्छता की िस्थित अत्यन्त खराब पाई गयी है। उक्त पत्र की छाया प्रित संलग्न कर आप लोगों को इस आशय के साथ प्रेिषत िक वादी के मकान/ मोहल्ले/ वाडर् नं०-2 नगर पंचायत खेतासराय जौनपुर में तत्काल प्रभाव से फै ले हुये कचरा कीचड इत्याित का सफाई करायी जाये एवं प्रभािवत क्षेत्र में सडक धुलाई, फािगग एवं सैिनटाइजेंशन कराते हुये नोडल अिधकारी लीगल सेल कायार्लय अधोहस्ताक्षरी से समन्वय स्थािपत करते हुये अनुपालन आख्या तैयार कराना सुिनिश्चत करें एवं कृ त कायर्वाही से अधोहस्ताक्षरी को अवगत कराना सुिनिश्चत करें िजससे ससमय अनुपालन आख्या मुख्य स्थायी अिधवक्ता, मा० उच्च न्यायालय इलाहाबाद में दािखल िकया जा सकें । इसमें िकसी भी प्रकार का िवलम्ब/ त्रुिट अपेिक्षत नहीं है। समयबद्धता का िवशेष ध्यान रखा जाय। WRIC No. 31172 of 2025 2 संलग्नक-यथोपरी । मुख्य िचिकत्सा अिधकारी जौनपुर।" 4. Accordingly, the writ petition is disposed off. The respondents No.2 and 3 are further directed to ensure that in future no filth, sludge and muck etc. be dumped in front of the residence of the petitioner.
