1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not deciding the Application No.TTA012400124228 submitted by the petitioner through the Integrated Service Delivery Gateway – “Mee Seva” on 03.12.2024 for deletion of my landed property of Ac.4.68
cents in Sy.No.605 situated at Tadikalapudi Revenue Village in Kamavarapukota Mandal of Eluru (erstwhile West Godavari) District and continuing the said Sy. Number in the list of properties Porhibited for Registration being maintained by the Respondents, as illegal, irregular, irrational, violative of the provisions of Registration Act, 1908 and offends Articles 14, 21 & 300-A of the Constitution of India and consequently direct the respondents to delete subject land from the list of properties prohibited for Registration being maintained by the Respondents under Section 22(A) of Registration Act, 1908 and to pass such other order or orders...”
1. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents. 2. The case of the petitioner is that the petitioner is the absolute owner of the agriculture landed property admeasuring to an extent of Ac.4.68 cents in Sy.No.605 situated at Tadikalapudi Revenue village in Kamavarapukota Mandal of West Godavari District and having acquired the same from her vendor and predecessor Sri Kudaravalli Krishnakumari under Registered Sale deed document bearing No.517/2021, dated 15.02.2021 and she is in peaceful possession and rightful enjoyer of the said subject land. 3. The learned counsel for the petitioner submits that the petitioner made an application to the respondent authorities seeking for deletion of the subject property from the list of prohibited properties under Section 22- A(1)(a) of the Registration Act, 1908, through the Integrated Service
Delivery Gateway “Mee Seva,” vide Application No. TTA012400124228, dated 03.12.2024.
He further submits that the subject property is not under any legal restraint against alienation, particularly in light of successive alienations that have been duly registered by the respondent authorities as per the directions of this Court vide orders dated 18.03.2013 and 21.01.2021 in W.P.Nos.7568 of 2013 and 1515 of 2021 He also contends that, despite the receipt of the petitioner’s application/representation dated 03.12.2024, the respondents have no lawful authority to continue listing the subject property under the prohibited properties list, especially considering that documents of conveyance related to the successive alienations have been already registered. Hence the writ petition. 4. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents submits that, the respondents’ authorities will consider the representation/application of the petitioner dated 03.12.2024 and pass appropriate orders within a reasonable time in accordance with law. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and on perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by directing the respondents’ authorities to consider the application/representation of the petitioner, dated 03.12.2024, for deletion
of the subject property from the prohibited list notified under Section 22- A(1)(a) of the Registration Act, 1908 as expeditiously as possible, strictly in accordance with the law, preferably within a period of four (04) months from the date of receipt of this order after providing an opportunity of hearing to all the parties concerned. 6. With the above direction the writ petition is disposed of. No order as to costs.
