The case of the petitioner is that his father is running a poultry farm over his own land and which is being objected to by respondent nos. 4 and 5. Further, his case is that the poultry farm of his father is situated beyond 500 meters from abadi and therefore, there is no impediment in running the same. 2. The aforesaid issue, in our considered opinion, cannot be decided in absence of U.P. Pollution Control Board, which is the Regulatory Authority. 3. Accordingly, we decline to entertain the petition and leave it open to the petitioner to approach U.P. Pollution Control Board for redressal, if so advised, or avail such other remedy as may be available to him. 4. The petition is disposed of accordingly.
