ORDER 02.06.2025
1. The instant contempt petition arising out of an Order dated 29th July,2022, passed in WP(C) No. 1605/2022, by virtue of which, the writ petition preferred by the petitioner was disposed of with the following observations:- i. The petitioner shall file a formal application projecting his grievance as projected in the writ petition before the Tehsildar, Kulgam. ii. The Tehsildar, Kulgam, on receipt of application, shall initiate proceedings in accordance with law. iii. The Tehsildar, Kulgam, shall do well to pass appropriate orders in the matter after hearing respondents 9 and 10 within a period of six weeks thereafter.
2. When the learned counsel for the petitioner was put to a query whether any such formal application in terms of Order dated 29th July, 2022, was filed or not, learned counsel for the petitioner did not give satisfactory reply. It seems that petitioner has not filed such application despite there being a direction of this Court.
3. In the aforesaid backdrop, nothing remains further to be adjudicated upon in the instant petition. Accordingly, the proceedings in the instant petition are closed. However, the Tehsildar, Kulgam, shall initiate the process on the application, if any, filed by the petitioner in terms of Order dated 22nd July,2022, after affording an opportunity of hearing to the petitioner as also respondents 9 and 10.
4. Petitioner shall be at liberty to seek revival of the instant contempt petition if cause survives and in that eventuality this Court shall be constrained to take coercive measures against the respondents.
