Sri Saurabh Tripathi, learned counsel for the applicants and Sri Rahul Pandey, learned brief holder for the State are present. The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the order dated 04.08.2025 passed by Chief Judicial Magistrate, Bijnor in Criminal Case No. 36420 of 2024, arising out Case Crime No. 1232 of 2023, under Sections 452, 436, 323, 324, 325, 307/34, 504, 506 IPC, P.S. Kotwali City, District Bijnor, whereby Non-Bailable Warrant has been issued. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
