Nepolean, learned senior counsel assisted by Ms. RK Emily, learned Deputy Government Advocate, takes notice for the respondents No. 1 and 2 and Ms. N. Savitri, learned counsel, takes notice for the respondent No. 3. Learned counsel appearing for the applicants prays for granting an interim order to stay the operation of the impugned order dated 04.03.2024 passed by the respondent and the writ petitioner has filed WP(C) No. 268 of 2024 on 15.04.2024 challenging the said impugned order dated 04.03.2024. The said impugned order dated 04.03.2024 reads as follows : “6. Now, therefore, under Rule No. 32(2)(iv) of Manipur Societies Registration Rules, 2004, I, Smt. Arambam Valentia, Registrar of Societies, Manipur, do hereby appoint Shri T. Somokanta Singh, Deputy Registrar of Societies, Imphal East as Liquidator with immediate effect for winding up the said Society SHAMURAILATPAM SUSHIL SHARMA Digitally signed by SHAMURAILATPAM SUSHIL SHARMA Date: 2025.02.19 11:29:37 +05'30' P a g e | 2 as per the provisions of Manipur Societies Registration Act, 1989 and its Rules, and Shri Yengkhom Mohenjit Singh, Sub Registrar, DCO Imphal East, to assist the Liquidator during the whole process of Liquidation, in addition to their normal duties. Further, the Liquidator shall ensure compliance of provisions of the Act and its Rules, and shall submit monthly progress report of the liquidation process of the Society on or before 5th of every month without fail.” The said writ petition, WP(C) No. 268 of 2024 is still pending before this Court and the writ petitioner is insisting upon for granting interim stay of the operation of the impugned order dated 04.03.2024. This Court has also perused the records. The learned senior counsel appearing for the respondents strongly objected for consideration of granting interim order at this stage. The learned senior counsel further states that the order of the Deputy Registrar of Society has already given effect by the respondents. Therefore, the prayer sought for by the petitioner will be decided at the time of hearing before the learned Single Judge. He also further submits that the matter is already heard by Hon’ble Mrs. Justice Golmei Gaiphulshillu and the matter may be treated as part-heard. At this juncture, the prayer to grant interim stay does not rise. Considering the aforesaid submission made by the parties, the petitioner has not obtained the benefit of interim order at the admission stage, and subsequently, the matter was listed as part heard, before Hon’ble Mrs. Justice Golmei Gaiphulshillu and same is pending before the same Judge, this Court is of the view that the said impugned order dated 04.03.2024 has already given effect by the respondent. Therefore, this Court is not inclined to grant interim order against the P a g e | 3 aforesaid impugned order passed by the respondent. It is made clear that the appointment of the Liquidator will be subject to the outcome of the order passed in the writ petition. With the above submission, the application is disposed of.
