ORDER The prayer in the writ petition is to call for the records relating to the impugned circular, dated 09.03.2025, bearing Ref.No.SF2/2004037/2025 inasmuch as Para No.5 of the same and quash the same and consequently, to direct the respondents to issue fresh tender in this regard. 2.The issue relates to use of machinery for removal of prosopis juliflora. Pending the present writ petition, in several other matters, we have already granted directions and reiterated that, considering the nature of prosopis tree, it is impossible to manually uproot and remove the same and we had already passed series of orders permitting the use of machineries and overturning the objections raised by the Forest Department, latest of that being passed on 07.11.2025 in W.P. (MD) No.3633 of 2014 and W.P.No.36417 of 2025. The said orders have become final. In view thereof, as a matter of fact, today, the learned Government Counsel would also submit that they are already implementing the orders and permitting the use of machineries. https://www.mhc.tn.gov.in/judis
W.P.No.27042 of 2025 3.In view thereof, nothing further remains to be adjudicated except to declare that Para No.5 of the impugned circular, dated 09.03.2025, shall not be implemented and in every tender, permission shall be granted for the use of machineries for removal of prosopis juliflora. 4.With such declaration and direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
