Through Secretary Revenue Department U.P., And 11 Others Counsel for Petitioner :- Mohd. Shahanshah Khan Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner and learned State Counsel for the State-respondents. In essence, the petitioner claims that injunction order has been violated by the private respondents. If that be so and in view of the fact that an application under Order 39 Rule 2 A CPC has already been instituted, remedy of the petitioner would be to pursue such proceedings. The writ petition would not lie for interference under Article 226 of the Constitution of India. Consequently, the instant writ petition is dismissed.
