In the present Regular Second Appeal, the plaintiff-appellant is challenging the judgment and decree dated 23.08.2023 passed by the First Appellate Court, whereby the judgment and decree dated 07.09.2022 passed by the trial Court, was set aside and his civil suit was dismissed. 2. At the outset, learned counsel for the respondents has submitted that the question of law involved in the present appeal as to whether jurisdiction of the Civil Court is barred in view of Section 145 of the Electricity Act, 2003, has since been decided by the Hon’ble Division Bench of this Court vide judgment dated 14.05.2025 passed in Mahesh Kumar Versus Sub Divisional Officer and another, reported in 2025(3) RCR (Civil) 303.
