No. 2021/2023/A4 and Na.Mu. No. 0386/2021/C, passed by the 2nd and 3rd respondents respectively, and pursuant thereto, facilitate the petitioner in identifying the boundaries of 24 cents of land in Survey No. 206/4C, situated in Perumbakkam Village, Madurantakam Taluk, Chengalpattu District. 2.
learned counsel for the petitioner submitted that although the petitioner submitted a representation dated 27.01.2025 seeking a survey of the subject land and the fixation of boundary stones, the same has not been considered by __________ Page3 of 7 https://www.mhc.tn.gov.in/judis
WP No. 21804 of 2025 the 4th respondent till date. Hence, he seeks appropriate directions to the 4th respondent. 3. The learned counsel for the 5th respondent submitted that the 5th respondent is in possession of an extent of 5 cents of land comprised in Survey No. 206/4A2 situated in Perumbakkam Village, Madurantakam Taluk, Chengalpattu District, and has also filed a civil suit for permanent injunction. 4. On a perusal of the records, it is seen that the properties of the petitioner and the 5th respondent are distinct and different. Hence, there is no legal impediment for the respondents to survey and demarcate the property as sought for in this Writ Petition. 5. Such being the case, the 4th respondent / Tahsildar, Madurantakam Taluk, is directed to conduct a survey of the subject property in Survey No. 206/4C, situated in Perumbakkam Village, Madurantakam Taluk, Chengalpattu District, and fix the boundary stones within a period of eight (8) weeks from the date of receipt of a copy of this order. This exercise shall be carried out after issuing prior notice to the petitioner, the 5th respondent, adjacent landowners, __________ Page4 of 7 https://www.mhc.tn.gov.in/judis

It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 6.
