Heard learned counsel for the petitioner, Sri Kaushlesh Pratap Singh, learned counsel for the Basic Education Officer and learned Standing Counsel for the State. 2. This petition has been filed with the prayer to quash the order dated 19.08.2025 passed by respondent no.4, by which the petitioner was transferred from Primary School, Ubari Kheda, Teekarai, Block Kamalganj, District Farrukhabad to Primary School, Harsinghpur, Nawabganj, Farrukhabad. 3. Learned counsel for the petitioner submits that earlier the petitioner was transferred to Primary School, Ubari Kheda, Teekarai, Block Kamalaganj, District Farrukhabad without giving opportunity to the petitioner and the petitioner has joined there on 13.8.2025, however, by order dated 19.8.2025 the aforesaid transfer order has been cancelled without notice or opportunity to the petitioner, therefore, the impugned order is arbitrary and against the principles of natural justice. 4. Learned counsel for the respondent nos.3, 4 and 5 in para 9 of the affidavit submitted that there is only one teacher working in the school and in view of Clause 6 of the Government Order dated 8.8.2025, the transfer order has been cancelled by the order impugned that too after giving notice to the concerned Block Education Officer. 5. The aforesaid fact has already been considered by the Court by order dated 3.9.2025, which reads as follows:- "1. Sri Mohit Dixit, learned Advocate holding brief of Sri Kaushlesh Pratap Singh, Versus Counsel for Petitioner(s) : Sita Ram, Vinod Kr Pandey Counsel for Respondent(s) : C.S.C., Kaushlesh Pratap Singh Reena Mashih .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) learned counsel for the respondent BSA, on the basis of instructions, submits that the impugned order has been in view of Clause-6 of the Government Order dated 08.08.2025, which reads thus: "6. स्वेच्छा से अन्तःजनपदीय स्थानान्तरण एवं समायोजन प्रिक्रया में स्थानान्तिरत ऐसे िशक्षक/िशिक्षका िजनको कायर्मुक्त करने से िवद्यालय एकल िशक्षक अथवा िशक्षक िवहीन हो रहा हो, को कायर्मुक्त नहीं िकया जायेगा।" 2. Learned Counsel for the respondent BSA is granted two weeks' time to bring the relevant material/ Government Order/ instructions, on which he is relying upon, by means of an affidavit. 3. Put up this case on 18th September, 2025, as fresh." 6. In view of the above, no interference is required. The writ petition is dismissed, accordingly. 7. Needless to say the petitioner shall be permitted to join at Primary School, Harsinghpur, Nawabganj, Farrukhabad, at the earliest.
