ORAL ORDER This petition is filed by accused No.1 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.134/2025 of Devanahalli Police Station registered for offence punishable under Sections 118(1), 127(4), 140(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023.

learned counsel for petitioner and learned High Court Government Pleader for respondent - State.

Learned counsel for petitioner would contend that, there is no serious overacts alleged against this petitioner. The serious overacts are alleged against other

accused. The wife of the petitioner gave birth to a child recently. The mother of the petitioner died on 04.10.2025 and father died on 20.10.2025. There is nobody to look after the wife and the newborn baby of the petitioner. The petitioner is in judicial custody since 07.10.2025. The major portion of the investigation is over. The petitioner is not required for further custodial interrogation. There are no criminal antecedents of the petitioner. With these, he prayed to allow the petition.
4. Per contra, learned High Court Government Pleader for respondent would contend that, the overacts are alleged against this petitioner is assault by cricket stump and causing injury. The wound certificate indicates that, the injured has sustained five (5) simple injuries. Innova car has been recovered at the instance of accused Nos.1, 2 and 3. The investigation is in progress. If the petitioner is granted bail, there are chances of him hampering the investigation and tampering the

prosecution witnesses. With these, she prayed for dismissal of the petition.
5. Having heard the learned counsels appearing for the parties, the Court has perused the FIR, complaint and other materials placed on record.
6. The complaint of one Mohammad Musthafa, a case has been registered against the petitioner and three others in Crime No.134/2025 of Devanahalli Police Station for the aforesaid offences. The allegation against the accused persons in the complaint is that, they took this complainant and assaulted him and demoted him and took his vehicle. The wound certificate indicates that, the complainant has sustained five (5) simple injuries. The petitioner is in judicial custody since 07.10.2025. As the major portion of the investigation is over, he is not required for further custodial interrogation. The offences alleged against the petitioner are not punishable either

with death or imprisonment for life. There are no criminal antecedents of the petitioner.
7. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted bail in Crime No.134/2025 of Devanahalli Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court. ii) The petitioner shall not threaten the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the trial Court on all dates of hearing unless

exempted by the Court and cooperate for speedy disposal of the case.
